Do A Quitclaim Deed In Michigan

File a quitclaim deed to move property from one person to another.


A quitclaim deed is a legal document involving the transfer of property. The deed shows that one party is officially giving up any claims or interest in a piece of property and another party is taking it over. These deeds are typically used in situations where one or more parties wishes to give up any claim on a property, such as during a tax sale or divorce. Quitclaim deeds are very simple documents (the legal part is generally less than half a page), and using a dynamic website to fill them out makes the process even easier.


Instructions


1. Log on to a website such as LawInfo.com to download a free quitclaim deed form. Several websites offer this service, but the LawInfo website doesn't require personal information or a subscription to use. If you need a non-dynamic (standard) form, check out the Lectric Law Library website. Both links are available in the Resources section of this article. You can also contact a local real estate company for a paper quitclaim deed form.


2. Fill in the required fields. The majority of the information is simple, like names and addresses, but you will also need to know the mortgage, encumbrance and acquisition information for the property. Financial information related to the property is only available to the owner, but assessment and tax information or property descriptions are available at the Assessor's Office at a county courthouse or from the online Michigan Assessor and Property Tax Records Directory.


3. If you are using an online form, Click Print, or Create Form at the bottom of the page. Your personalized document will display on the screen so you can print it.


4. Wait to sign the form. In order to complete the form you will need the signatures of the original owner (grantor), the new owner (grantee), a notary and two witnesses. All of these signatures need to take place in front of the notary.


5. Take the form to your local courthouse.


6. Sign your deed in front of a notary and two witnesses; you should be able to find both at the courthouse. Most notaries in the state of Michigan do not charge a fee.


7. File your deed at the county clerk's office.


Tips Warnings


Technically, anybody can file a quitclaim deed as long as all the signatures are present and notarized. If the property owners cannot meet up, they may notarize their signatures individually and mail the deed back and forth between the required parties.


Michigan is one of the states that require witnesses in addition to the notary, so make sure you have the proper signatures.
